PARADE SPRING DECLUTTERING SWEEPSTAKES

Official Rules

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN A PRIZE. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.                                                               

1. Sweepstakes Period: The Parade Spring Decluttering Sweepstakes (the “Sweepstakes”) commences at 12:01 AM Eastern Time (“ET”) on February 23, 2018, and ends at 11:59 PM ET on April 2, 2018 (the “Sweepstakes Period”). 
2. Administrator/Sponsor: The Sweepstakes shall be administered and sponsored by Athlon Sports Communications, Inc., d/b/a AMG/ Parade (“SPONSOR”).
3. Eligibility:  The Sweepstakes is only open to legal residents of the forty-eight (48)  contiguous United States and the District of Columbia (excluding residents of Puerto Rico and US territories and possessions).  All Sweepstakes participants and entrants (collectively, “Entrants”) must be at least eighteen (18) years of age or older as of the beginning of the Sweepstakes Period.  Employees (and their immediate families (i.e., parents, spouse, children, siblings, grandparents, step-parents, step-children and step siblings and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of SPONSOR, and its affiliated companies, subsidiaries, advertising and Sweepstakes agencies and third party fulfillment or judging agencies (collectively, the “Sweepstakes Entities”), are not eligible to participate in the Sweepstakes or win any prize. The Sweepstakes is void where prohibited by law, or otherwise restricted. All federal, state and local laws and regulations apply.
4. How to Enter Online: To enter the Sweepstakes, go to www.parade.com/clutter (“the “Website”) during the Sweepstakes Period and follow the on-screen instructions to: (a) complete all registration fields contained on the Sweepstakes entry page, (b) submit a photograph of “a room where Entrant needs the most help decluttering” (the “Submission”); and (c) electronically agree to and accept these Official Rules (collectively, the “Entry”).  Limit one (1) Entry per person.  Any Entrant who attempts to participate with multiple e-mail and/or street addresses, under multiple identities or uses any device or artifice to enter multiple times in violation of applicable entry limitations may be disqualified by SPONSOR in its sole discretion.  The Website’s clock will be the official timekeeper for the Sweepstakes. Any use of robotic, repetitive, automatic, programmed or similar entry methods or agents will void all Entries (as defined below) made by, or associated with, the applicable Entrant.  In the event of a dispute over who submitted any Entry, the authorized subscriber of the e-mail account provided in connection with the Entry, as of the actual time that such Entry was received by SPONSOR, will be deemed to be the Entrant.  The “authorized account subscriber” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization (e.g. business, education, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.  A selected, or potential winning “authorized account subscriber” may be required to provide SPONSOR with proof that he/she is the authorized account holder of the e-mail address associated with the applicable Entry. By entering this Sweepstakes, each Entrant agrees that SPONSOR has the right to contact Entrant by telephone, email or regular mail. Entrants may also be asked to consent to receive promotional mail and emails from SPONSOR and its promotional partners, provided that consenting to receive such mail and emails is optional and will not increase, or otherwise effect, any chance of winning.

Requirements for Submissions:  To be eligible for the Sweepstakes, the Submission that Entrant submits must meet all of the following criteria:  (1) The photograph submitted must have been taken by Entrant and must be Entrant’s original work.  (2) The photograph must not infringe or misappropriate the rights of any party, including, without limitation, any copyright rights, trademark rights, rights of publicity, or rights of privacy.  (3) The photograph, including all material and all rights embodied therein, will become the sole and exclusive property of SPONSOR immediately upon submission. (4) By submitting the photograph, Entrant represents and warrants to SPONSOR that the Submission satisfies each of the foregoing requirements.  Failure to satisfy any of these requirements, as determined by SPONSOR in its sole and absolute discretion, may render you and your photograph ineligible.

5. Sweepstakes Prize: There is exactly six (6) prizes (each a “Prize”) available to be won in connection with the Sweepstakes, which shall consist of five (5) runner-up Prizes (each, a “Runner-Up Prize”) and one (1) First Place Prize (“First Place Prize”).  Odds of winning the Prize depend on the number of eligible Entries received. The Prize winners will be determined by a random drawing from among all eligible Entries received and will be held on or about April 4, 2018 at a location determined by SPONSOR.  

Subject to these Official Rules, the Runner-Up Prize will consist of one (1) signed copy of “Decluttering at the Speed of Light” by Dana K. White (ARV: $17.00), and the First Place Prize will consist of one (1) eight hour in-home decluttering session with author and clutter expert, Dana K. White and one (1) signed copy of “Decluttering at the Speed of Light” by Dana K. White (ARV: $3,117.00). Prize winner is solely responsible for any and all applicable fees and taxes associated with receipt and use of the Prize, and SPONSOR will provide the Prize winner with an IRS Form 1099 reflecting the actual final retail value of the Prize. All Prizes must be redeemed by July1, 2018. Winner will be required to coordinate with representatives of clutter expert Dana K. White to schedule the in-home declutter session. Session date must be confirmed at least 30 days prior to redemption of prize. Dana K. White reserves the right to reject locations that she deems unsafe to visit.

6. Notification: All Prize winners will be notified by email within seven (7) days of the applicable drawing date.  The Prize winner may be required to sign an affidavit of eligibility and release of publicity/liability (“Affidavit”) (where legal) within seven (7) days.  If any email is returned as undeliverable, a potential Prize winner cannot be contacted within seven (7) days of the first attempt to contact him/her, fails to return the signed Affidavit within seven (7) days, or if the potential Prize winner is deemed ineligible for any other reason in SPONSOR’s sole discretion, including failure to comply with these Official Rules, the applicable Prize will be forfeited, the potential Prize winner will be disqualified, and an alternate Prize winner will be selected in his/her place by random drawing amongst all remaining eligible Entries received.
7. General Terms: By entering or otherwise participating in the Sweepstakes and/or accepting any Prize, the Entrant hereby fully and unconditionally agrees to be bound by these Official Rules and the decisions of SPONSOR, or its designated agent, which are final and legally binding in all respects, and agrees to waive any right to claim any ambiguity in these Official Rules. The Entrant also agrees to assume all risk of loss, damage, destruction, delay or misdirection of materials/mail/email submitted to or from SPONSOR, and further agrees that all Prizes are awarded upon the condition that SPONSOR or any of its affiliates, officers, directors, partners, principals, employees or agents shall have no liability whatsoever and shall be held harmless for any injuries, losses, or damages of any kind to persons or property, including death, sustained, in whole or in part, directly or indirectly, in connection with or resulting from acceptance, possession or use/misuse of any Prize, or participation in this Sweepstakes or participation in any Sweepstakes-related activities and further acknowledge that said parties have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize awarded in connection with the Sweepstakes. The sale, re-sale, auction, transfer or assignment of any prize intended to be personal to the recipient or the advertising of same in any way is strictly prohibited and any Prize winner found to have engaged in such activity will be immediately disqualified and his/her prizes will be forfeited.

SPONSOR reserves the right, in its sole discretion, without prior notice and at any time, to cancel, terminate or suspend this Sweepstakes, or any portion thereof, should virus, bugs, non-authorized human intervention or other causes beyond the control of SPONSOR corrupt or impair the administration, integrity, security, fairness or proper conduct of the Sweepstakes. In such event, SPONSOR, at its discretion, may select winners from the eligible, non-suspect Entries received prior to the event requiring such termination, cancellation or suspension. SPONSOR and its affiliates, officers, directors, employees or agents are not responsible for hardware, software or telephone failures of any kind, traffic congestion on the internet or at any website or any combination thereof, lost network connections, incomplete, garbled or delayed computer transmissions, whether caused by SPONSOR, users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by technical or human error which may occur and/or which may damage a user’s system or limit Entrant’s ability to participate and/or redeem Prizes in the Sweepstakes.  SPONSOR reserves the right at its sole discretion, to disqualify any individual who tampers with the Sweepstakes, violates these Official Rules or otherwise engages in fraudulent or offensive conduct with respect to this Sweepstakes. Caution:  Any attempt to deliberately damage any website or undermine the legitimate operation or administration of the Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, SPONSOR reserves the right to seek damages from any such Entrants to the fullest extent of the law.

      By accepting a Prize, the Prize winner agrees that SPONSOR may use such Prize winner's name, likeness, voice, photograph and/or biographical information, without limitation, for promotional purposes without further consideration or payment, where permitted by law. Prizes are awarded “as is,” “where is,” with no warranty or guarantee express or implied.  Prizes are nonassignable and nontransferable. No substitutions allowed, except SPONSOR reserves the right to substitute cash or prizes of equal or greater value.  SPONSOR’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Should any provision of these Official Rules be deemed unenforceable or invalid, the other provisions of these Official Rules shall remain in full force and effect. In the event that this Sweepstakes is challenged by any legal or regulatory authority (including but not limited to any federal or state governmental authority), SPONSOR reserves the right to discontinue or modify the Sweepstakes, as applicable, or to disqualify any Entrants residing in any affected geographic areas, as applicable. In such event, SPONSOR shall have no liability to any Entrants who are disqualified due to such an action.

8. Rights in Submissions: As set forth above, including in Section 4, as a condition of participating in the Sweepstakes, any Submission that Entrant submits, including all copyright rights and other intellectual property rights in and relating to that Submission, immediately become the sole and exclusive property of SPONSOR.  As the owner of all rights in each submitted Submission, SPONSOR has the perpetual, worldwide right (but no obligation) to edit, adapt, modify, reproduce, display, publish, distribute, assign, sell, transfer, and otherwise use (unless prohibited by applicable law) the Submission (including all material embodied therein) in any way, in any media now or hereafter known, and for any purpose, including trade, advertising or promotional purposes, as SPONSOR determines, in its sole and absolute discretion, without further notice or compensation to Entrant or to any other parties.  In addition, each Entrant warrants that any so called “moral rights” in the Submission have been waived and Entrant acknowledges and agrees that SPONSOR may use any ideas from any Submission or other submitted materials, whether or not Entrant has been awarded a prize in connection with any such Submission or other materials.
9. Dispute Resolution: Except where prohibited, Entrants agree that: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any participant(s), SPONSOR and its agents shall be governed by and construed exclusively in accordance with the laws of the State of Tennessee without giving effect to any principles of conflicts of law of any jurisdiction. Entrants agree that any action at law or in equity arising out of or relating to this Sweepstakes, or awarding of the Prize, shall be filed only in the state or federal courts located in the State of Tennessee and the Entrants hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Sweepstakes, the Entrants agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or awarding of the Prize, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitations or exclusion of liability for incidental or consequential damages, so the above may not apply to you.
10. Privacy: All personal information that Entrants submit will be subject to SPONSOR’s privacy policy.  In the event of any discrepancy between SPONSOR’s privacy policy and these Official Rules, the privacy policy will govern and control. 11. Request for Names of Prize Winner and Official Rules: For the names of the Prize winner and/or a copy of these Official Rules, send a self-addressed stamped envelope to: Parade Oscars Sweepstakes 2451 Atrium Way, Suite 320, Nashville, Tennessee 37214. Vermont residents may omit return postage on the self-addressed envelope. All requests for a copy of the Official Rules and the names of winners must be made by July 31, 2018. Please note on the front left-hand corner of your outer envelope whether you are requesting “Official Rules” or the names of “Prize Winners.”
